Terms of Service
These Terms of Service ("Terms") govern your access to and use of the PacketSense software, plugin, websites and cloud services (together, the "Service"), operated by PacketSense ("PacketSense", "we", "us"). By installing, accessing or using the Service, or by purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
PacketSense provides WordPress security software in a free tier and a paid "Pro" tier, together with optional cloud services for licensing, threat intelligence, monitoring and account management. We may add, change, suspend or discontinue features at any time.
2. Accounts
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account and for the sites you connect. You must be at least the age of majority in your jurisdiction and have authority to bind any organisation you represent.
3. Subscriptions, Billing and Renewals
Paid plans are billed in advance on a recurring (monthly or annual) basis through our payment processor, Stripe. By subscribing you authorise us and Stripe to charge your payment method for the then-current fees, applicable taxes and any recurring charges until you cancel. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. We may change prices on prospective renewals with reasonable notice.
4. Cancellations and Refunds
You may cancel at any time through your account or the billing portal; cancellation takes effect at the end of the current paid period and you retain access until then. Except where required by law, fees are non-refundable and partial periods are not refunded. Any voluntary refunds are at our sole discretion.
5. Licence and Restrictions
Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Service for the number of sites ("seats") covered by your plan. You may not: (a) redistribute, resell, sublicense or share the Pro package or license keys; (b) exceed your licensed seats; (c) reverse engineer, decompile or circumvent licensing, except where such restriction is prohibited by law; or (d) remove proprietary notices.
6. Acceptable Use
You will use the Service only for lawful purposes and only to protect systems you own or are authorised to protect. You must not use the Service, or any security tooling it provides, to attack, scan, disrupt or gain unauthorised access to any system, to violate any law, or to infringe the rights of others. We may suspend or terminate access for violations or suspected abuse.
7. Intellectual Property
The Service, including all software, content, rules, signatures and trademarks, is owned by PacketSense and its licensors and is protected by intellectual-property laws. Except for the limited licence above, no rights are granted to you. Feedback you provide may be used by us without obligation.
8. Third-Party Services
The Service relies on third parties (for example Stripe for payments and email/hosting providers). Your use of those services may be subject to their terms, and we are not responsible for third-party services.
9. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose and non-infringement. Security software cannot guarantee detection or prevention of all threats, vulnerabilities, malware or intrusions, and we do not warrant that the Service will be uninterrupted, error-free or that any site will be secure. You remain responsible for your own backups, security practices and compliance.
10. Limitation of Liability
To the maximum extent permitted by law, PacketSense and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, or for damages arising from security incidents, downtime or unauthorised access. Our total aggregate liability for all claims relating to the Service will not exceed the amount you paid to us in the twelve (12) months before the event giving rise to the claim.
11. Indemnification
You will indemnify and hold harmless PacketSense from any claims, damages and expenses arising out of your use of the Service, your content or sites, or your breach of these Terms or of any law or third-party right.
12. Termination
We may suspend or terminate your access at any time for breach of these Terms, non-payment, or suspected abuse. On termination your licence ends and you must stop using the Pro software. Sections that by their nature should survive (including IP, disclaimers, liability limits and indemnity) survive termination.
13. Changes to the Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date and, where appropriate, notified to you. Continued use after changes take effect constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of its courts, except where mandatory local law provides otherwise.
